These Terms and Conditions ("Terms") govern your use of the website https://talent-flow.org, the Talent Flow services, and the Talent Flow SMS/text messaging program (together, the "Services"), operated by Talent Flow LLC ("Talent Flow," "we," "us," or "our"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Use of the Services

You must be at least 18 years old to use the Services. You agree to provide accurate information and to use the Services only for lawful purposes. We may suspend or end your access if you misuse the Services.

2. SMS/Text Messaging Program Terms

Program name: Talent Flow Notifications.

Program description: When you opt in, Talent Flow will send you text messages about job opportunities, application status, interview scheduling and reminders, onboarding steps, account notifications, and customer support. Message frequency varies based on your activity.

How you opt in: You consent to receive text messages only by (a) checking the SMS consent box on a Talent Flow web form and submitting your mobile number, or (b) texting START to our number. The consent box is never pre-checked. Consent to receive text messages is not a condition of any purchase, application, or service.

Confirmation message: After you opt in, you will receive one message confirming your enrollment: "Talent Flow: You are subscribed to Talent Flow Notifications. Msg frequency varies. Msg & data rates may apply. Reply HELP for help, STOP to opt out."

How to opt out: You can cancel at any time. Reply STOP to any Talent Flow message. We also honor STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, REVOKE, and OPTOUT, as well as any reasonable request to stop. After you text STOP, you will receive one final message confirming you have been unsubscribed: "Talent Flow: You have been unsubscribed and will receive no further messages. Reply START to resubscribe." After that, you will receive no further text messages from us unless you opt in again. To rejoin, reply START or UNSTOP, or opt in again through our web form.

How to get help: Reply HELP (or INFO) to any message for assistance: "Talent Flow: For help, email hr@talent-flow.org. Msg frequency varies. Msg & data rates may apply. Reply STOP to opt out." You can also contact us directly at hr@talent-flow.org.

Costs: Message and data rates may apply. Check your mobile plan with your wireless carrier for details. Talent Flow does not charge for text messages.

Carrier liability: Wireless carriers are not liable for delayed or undelivered messages.

Supported carriers: The program is available on major U.S. carriers, including AT&T, Verizon, T-Mobile, and most regional carriers. Carrier availability may change.

Your mobile number: You confirm that you are the account holder or authorized user of the mobile number you provide. If you change or deactivate that number, you agree to text STOP from it or notify us so we stop messaging it.

Privacy: Your information is handled under our Privacy Policy. We do not sell, rent, or share your mobile number or SMS opt-in consent with third parties or affiliates for their marketing or promotional purposes.

3. Intellectual Property

All content on the website and in the Services, including text, graphics, logos, and software, belongs to Talent Flow or its licensors. You may not copy, modify, or distribute it without our written permission.

4. Third-Party Services

The Services may link to or rely on third-party websites or services. We are not responsible for their content or practices.

5. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Services, including text messages, will be uninterrupted, timely, or error-free, or that any job opportunity, placement, or outcome will result from using them.

6. Limitation of Liability

To the fullest extent permitted by law, Talent Flow will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, including any delayed or undelivered text messages.

7. Indemnification

You agree to indemnify and hold Talent Flow harmless from claims arising from your misuse of the Services or your violation of these Terms.

8. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page with a new effective date. Continued use of the Services after changes means you accept them.

9. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-law rules.
